2. "0.00% THC" / "THC-FREE" & THIRD-PARTY TESTING DISCLAIMERS

2.1 **Definition of 0.00% THC.** Where products are marketed, labeled, or described as "0.00% THC," "THC-Free," "Non-Detect," or "ND," this refers strictly to the results of independent, third-party laboratory testing (Certificates of Analysis or "COAs"). It signifies that Tetrahydrocannabinol (THC) levels fell below the limit of quantitation (LOQ) or detection limits utilized by the testing facility.

2.2 **Natural Variability.** Hemp extracts are naturally derived agricultural products. While Hampsan LLC employs strict extraction, purification, and remedial processing techniques to isolate cannabinoids and remove THC, absolute mathematical zero across every molecule cannot be unconditionally guaranteed due to variance in laboratory instrumentation, testing sensitivities, and natural organic properties. 

 

3. DRUG TEST AND WORKPLACE LIABILITY WAIVER

3.1 **Assumption of Risk.** Hampsan LLC explicitly makes no guarantee, representation, or warranty that the use of its 0.00% THC or THC-free products will ensure a negative result on any drug screening, workplace drug test, or legal sobriety panel.

3.2 **Factors Influencing Drug Tests.** Drug screenings often look generically for cannabinoid metabolites and can yield false-positive results due to individual metabolic variations, cross-reactivity with secondary cannabinoids (such as CBD, CBG, or CBN), or different testing methodologies (such as initial immunoassay screens vs. confirmatory gas chromatography-mass spectrometry).

3.3 **Release of Liability.** By purchasing and consuming these products, you voluntarily assume all risks associated with drug testing. Hampsan LLC, its affiliates, directors, officers, and employees shall not be held liable, financially or otherwise, for any adverse consequences resulting from a failed or positive drug test, including but not limited to loss of employment, disciplinary action, termination of contracts, or legal penalties.

 

4. AGE RESTRICTIONS AND USER ELIGIBILITY

4.1 **Minimum Age.** By accessing this Website and purchasing any products, you represent and warrant that you are at least twenty-one (21) years of age (or eighteen (18) years of age where permitted by applicable local jurisdiction) and possess the legal capacity to enter into a binding agreement.

4.2 **Verification.** Hampsan LLC reserves the right to utilize third-party age verification software or request valid, government-issued identification to confirm your age before processing or shipping any order.

 

5. GEOGRAPHIC COMPLIANCE AND SHIPPING RESTRICTIONS

5.1 **Compliance with Local Laws.** Hemp and cannabinoid regulations are highly fragmented and continuously evolving at federal, state, and local levels. You agree that it is your sole responsibility to ascertain, understand, and obey all applicable local, state, federal, and international laws regarding the possession, use, and distribution of CBD products in your jurisdiction.

5.2 **Right to Cancel.** Hampsan LLC restricts shipments to certain states, municipalities, or jurisdictions where local statutes enforce a strict, zero-tolerance policy on all hemp-derived cannabinoids or require specific retail licensing. Hampsan LLC reserves the right to refuse service, cancel orders, and issue refunds immediately if a shipping destination is determined to be a high-risk or prohibited jurisdiction.

 

6. LIMITATION OF LIABILITY

6.1 **Cap on Damages.** To the maximum extent permitted by applicable law, Hampsan LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, personal injury, or property damage arising out of or relating to your use of the Website or products.

6.2 **Maximum Recovery.** In no event shall Hampsan LLC total collective liability to you for all claims, damages, losses, and causes of action exceed the actual dollar amount paid by you to Hampsan LLC for the specific product giving rise to the claim, or one hundred U.S. dollars ($100.00), whichever is lesser.

 

7. GOVERNING LAW AND DISPUTE RESOLUTION

7.1 **Jurisdiction.** These Terms and Conditions, and any dispute arising out of your relationship with Hampsan LLC, shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles.

7.2 **Mandatory Arbitration.** You agree that any legal dispute, controversy, or claim arising out of or relating to these Terms, the breach thereof, or the purchase and use of any products shall be settled via binding, individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. 

7.3 **Class Action Waiver.** You explicitly waive any right to resolve disputes on a class, collective, or representative basis, or to participate as a class member in any class action lawsuit against Hampsan LLC.
